These Terms of Service (“Terms”) govern your access to and use of the Granite Earth Stone Fabrication Products website, products, and services (collectively, the “Services”). By using our Services or placing an order, you agree to these Terms.
1) Company Information

2) Eligibility & Account Responsibility
You represent that you are at least 18 years old (or the age of majority where you live) and legally able to enter into a contract. If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
3) Orders & Acceptance
All orders are subject to our acceptance. We may refuse or cancel any order for reasons including (but not limited to) suspected fraud, pricing or listing errors, inventory availability, shipping limitations, or order verification. If we cancel an order after you have been charged, we will refund the charge to the original payment method.
4) Pricing, Taxes, and Payment
All prices are listed in U.S. dollars unless otherwise stated and may change without notice. You are responsible for applicable taxes, duties, brokerage fees, and other government charges unless explicitly stated otherwise. Payment must be received before shipment unless you have approved credit terms in writing from Granite Earth.
5) Shipping, Delivery, and Risk of Loss
Shipping and delivery dates are estimates and not guaranteed. Risk of loss and title pass to you when the product is tendered to the carrier or shipped from our facility or from the manufacturer/supplier (as applicable), unless otherwise required by law. You are responsible for providing accurate shipping information. Carrier fees for address corrections, reconsignments, storage, or re-delivery are your responsibility.
6) Inspection, Shortages, and Damaged Shipments
Inspect all shipments immediately upon delivery. If there is visible damage, note it with the carrier at delivery whenever possible. Any claim for shipping damage, missing items, or incorrect items must be reported to Granite Earth within [X] days of delivery and should include photos and supporting documentation. Late notice may limit our ability to assist.
7) Returns, Refunds, and Restocking Fees
Returns are governed by our Returns Policy, which is incorporated into these Terms by reference.
Summary of key return terms (see Returns Policy for full details):
- Regularly stocked items may be returned if unused and in original packaging, and returned within 30 days from receipt, after obtaining a Return Authorization (RA).
- Upon receipt and inspection of returned product(s), your credit card will be credited for the amount paid for the item(s) minus a 20% restocking fee.
- Made-to-order items are non-returnable, including Jibs, Booms, and Forklift attachments.
- Due to safety requirements for material handling and care, clamps, lifters, slings, and shackles are non-returnable once used (these items may only be returned if unused and in original packaging).
- Special Order items, equipment, or items shipped directly from the manufacturer may be returned if unused, based on the manufacturer’s return policy, including varying restocking fees.
- Return shipping is the customer’s responsibility. For international returns, you are responsible for brokerage fees, duties, and taxes that may be applied (including fees that may be assessed after the return is completed).
8) Manufacturer Warranty & Defective/DOA Items
Some products are covered by manufacturer warranties. Returns of defective or DOA items are handled based on the manufacturer’s return/warranty policy, which may include troubleshooting, repair, replacement, or other remedies. We may assist with setting up a return or claim with the manufacturer, but warranty outcomes are determined by the manufacturer’s policies.
9) Product Information, Compatibility & Safety
We strive to display accurate product information, but descriptions, specifications, images, and availability may contain errors. You are responsible for confirming compatibility and suitability for your application before ordering.
Many products sold by Granite Earth may be used for lifting, rigging, and material handling. Improper use can result in injury, death, or property damage. Always follow manufacturer instructions, applicable standards, and safety regulations, and inspect safety-related equipment before each use.
10) Prohibited Use
You agree not to:
- use the Services for unlawful purposes;
- interfere with or disrupt site functionality or security;
- attempt unauthorized access to systems, accounts, or data;
- transmit malware, scraping bots, or harmful code;
- infringe or misuse intellectual property.
11) Intellectual Property
All content on our website—including text, images, graphics, logos, product information, and software—is owned by Granite Earth or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.
12) User Content & Reviews
If you submit reviews, feedback, images, or other content, you grant Granite Earth a non-exclusive, worldwide, royalty-free license to use, reproduce, publish, and display that content for business purposes. You agree not to submit content that is unlawful, defamatory, or infringes another party’s rights.
13) Limitation of Liability
To the fullest extent permitted by law, Granite Earth is not liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, lost revenue, downtime, or business interruption, arising out of or related to your use of the Services or products purchased through the Services.
Granite Earth’s total liability for any claim will not exceed the amount you paid to Granite Earth for the product(s) giving rise to the claim.
14) Disclaimers
Except as expressly stated in writing, the Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, Granite Earth disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where prohibited.
15) Indemnification
You agree to indemnify and hold harmless Granite Earth and its officers, employees, affiliates, and agents from claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, violation of these Terms, or violation of any law or third-party right.
16) Privacy
Your use of the Services is subject to our Privacy Policy. [Link/Reference]
17) Governing Law & Venue
These Terms are governed by the laws of the State of Ohio, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Services will be brought in the state or federal courts located in Butler County, Ohio, unless otherwise required by law.
18) Changes to These Terms
We may update these Terms from time to time. The Effective Date above indicates when these Terms were last updated. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
19) Severability
If any part of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
